Terms of Service & Operational Agreement

By accessing this website, requesting an ecommerce audit, or engaging Digeras for ongoing store operations, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a business entity, you represent that you have the authority to bind that organization.

Trading Swift LLC dba Digeras operates as an Enterprise Ecommerce Service Provider & Management Agency, providing full-service store management, checkout tuning, ERP synchronization, and catalog optimization for brands operating on Shopify Plus, Adobe Commerce, and composable commerce setups.

Complimentary audits provided through digeras.com evaluate publicly observable storefront factors, including checkout flow latency, mobile responsiveness, structured data graphs, and catalog indexing.

Audit reports are provided for informational and preliminary assessment purposes only. While our technical team conducts rigorous evaluations, audits do not constitute a warranty of specific revenue outcomes or exhaustive security certifications.

Client engagements operate under formal Master Services Agreements (MSAs) and Statements of Work (SOWs) specifying monthly management retainer tiers ($4,500 to $15,000+ USD/month), dedicated hours, SLA response guarantees (e.g., 15-minute emergency response), and systems engineering deliverables.

Retainers are billed monthly in advance. Service Level Agreements (SLAs) cover active retainer clients during designated business and on-call operational windows.

To provide services, clients grant Digeras appropriate collaborator or staff permissions to their commerce platforms (Shopify Plus, Adobe Commerce), ERPs (NetSuite, SAP), payment processors (Stripe), and marketing systems.

Clients retain full ownership of their storefront accounts, customer data, and third-party platform licenses. Digeras is not responsible for outages or fee changes imposed by third-party platform providers.

Upon receipt of full payment, custom code, bespoke theme extensions, and custom workflows developed specifically for a client belong exclusively to that client.

Digeras retains ownership of pre-existing proprietary modules, internal deployment toolkits, and general systems engineering methodologies developed independently of client engagements.

To the maximum extent permitted by applicable law, in no event shall Trading Swift LLC dba Digeras, its officers, or its engineers be liable for indirect, incidental, consequential, special, or punitive damages—including lost profits, data loss, or business interruption—arising out of or in connection with the use of this website or our advisory resources.

Our aggregate liability for formal client engagements is governed by the liability caps set forth in the executed Master Services Agreement.

Our website, articles, and documentation contain links to external third-party sites, tools, and platforms not owned or controlled by Digeras. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

These Terms of Service and any disputes arising out of or related to our website or services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Wyoming, United States.
